JungleBike complies with the law and takes the protection of users’ and members’ personal data very seriously.
This page complies with the French Data Protection Act of January 6, 1978, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, relating to the protection of natural persons with regard to the processing of personal data, the General Data Protection Regulation (GDPR).
Definition: “Personal Data” refers to any information relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, or an online identifier.
1. What is this about?
- “Member(s)”; “You”; “Your” refer to any natural person holding a Customer Account allowing access to specific features of the JUNGLEBIKE Site or Services;
- “User(s)” refers to any natural person accessing the Site(s) and Services without having created a Member Account and using only certain features of the JUNGLEBIKE Site(s) or Services;
- “Third Party” refers to any natural or legal person other than JUNGLEBIKE, a User, or a Member;
- “Customer Account” refers to any customer account created and allowing a Member to access specific features;
- “Services” refer to all or part of the services offered by JUNGLEBIKE on its Site;
- “Site” and “Our” refer to the website published by JUNGLEBIKE and the Services available at www.junglebike.fr or any other website related to the Services;
- The terms “personal data,” “Process/Processing,” “Data Controller,” “Processor,” “Recipient(s),” and “Consent” have the same meaning as defined in Article 4 of the GDPR.
2.1. Who are the final recipients of your Personal Data?
JUNGLEBIKE undertakes to take all necessary precautions and appropriate organizational and technical measures to preserve the security, integrity, and confidentiality of Personal Data, and in particular to prevent it from being altered, damaged, or accessed by unauthorized Third Parties. The Personal Data database created through your use of the Services is strictly confidential.
The recipients:
- Authorized JUNGLEBIKE staff (e.g., departments responsible for marketing, research and analysis, consumer panels, customer service, litigation, accounting and tax matters, IT, and information systems security).
- Payment service providers, IT service providers, and providers involved in the advertising sector.
- Competent authorities upon request, including public bodies (exclusively to comply with legal obligations), legal auxiliaries, ministerial officers, and organizations responsible for debt recovery.
- Social networks: if the User or Member has an account on social networking sites and accesses the Services, these may include plugins such as “Like” buttons or sharing or redirection buttons, allowing content from the Services to be published on social networks. In this case, the relevant social networks may receive information relating to the use of the Services by the User or Member. The social network is solely responsible for subsequent processing of the User’s or Member’s Personal Data collected from the Site via the plugin, and such processing is subject to the terms of use of the social networks to which the User or Member subscribed when creating an account.
2.2. Is your Personal Data transferred outside France?
The various categories of Personal Data of Users and Members may be processed outside the European Union. To secure transfers outside the European Union, the processors working with JUNGLEBIKE undertake not to transfer Personal Data outside the EU without implementing appropriate safeguards in accordance with applicable regulations.
3. Why is your Personal Data used?
Your Personal Data is processed for customer relationship management purposes and to enable JUNGLEBIKE to better interact with Users and Members, optimize the User experience, and respond to requests and possible complaints:
- Create a customer account.
- Collect comments and reviews. Manage our contractual and commercial communications. Track our exchanges in the event of disputes (in particular via customer service accessible by phone or instant messaging such as chat; these exchanges may be recorded for service improvement purposes).
- Manage requests relating to the exercise of rights, including access, rectification, and objection, in accordance with applicable regulations.
- Manage product recalls initiated by suppliers or the sending of related information or documents.
- Manage the risk of fraudulent use of your Personal Data or the Services.
JUNGLEBIKE may use your data for commercial prospecting operations or studies aimed at improving knowledge of Users, Members, and Services:
- Analysis of the use of the Services (including online navigation and reactions to emails), so that we can better understand you, assess interest in the Services offered and the messages sent to you, and offer tailored offers, content, and services; these analyses will be carried out in compliance with any authorizations you may have granted, particularly in the case of cookies or other trackers.
- Depending on your profile and your consent: sending promotional messages and content or personalized or non-personalized advertisements, by postal or electronic means, including mobile notifications.
JUNGLEBIKE may use your data for technical operations:
- Assign an identifier to your Personal Data.
- Detect anomalies and secure your Personal Data as well as our information systems through which your data is processed.
4. What are the legal bases for processing your Personal Data?
In addition to the legislative texts mentioned above, your Personal Data is processed under the General Terms and Conditions of Sale (GTC) for the provision of services, based on your consent (when cookies are placed and read on your device), and on the legitimate interest of JUNGLEBIKE and its partners, while respecting your interests, freedoms, and fundamental rights.
5. What personal information and data are collected by JUNGLEBIKE?
We inform you when certain Personal Data is required (whether mandatory or optional). If you refuse to provide mandatory data, certain features of JUNGLEBIKE services may not be available.
We may collect the following categories of Personal Data (Users and Workshops):
Users:
- Browsing data, as well as email address for receiving the JUNGLEBIKE newsletter (Consent is given through voluntary submission of information in the newsletter subscription form. Users may unsubscribe at any time via the link in the newsletter or by sending a message; the email address will then be removed from the distribution list).
- To ensure fast and efficient bicycle repair as part of the Service, we may share personal data with our bicycle repair partners, limited to what is necessary for the intervention, such as identity information and the location of the bicycle to be repaired. We contractually ensure that our repair partners process your Personal Data securely and confidentially.
Workshops:
- Your browsing data.
- Identification data (collected when creating a Customer Account, including title, last name, first name, email address, encrypted password, phone number, and optionally date of birth).
- Order data (primary address and information required to access the residence; if delivery is to a Third Party, the Third Party’s identification and address details). Payment details (credit card number, IBAN, etc.) are processed directly by our payment provider: PAYGREEN.
- Your reviews and comments posted on the platform.
- Your order history (including order date, order number, order contents, cost of products and services, and order status).
- Email address for receiving the JUNGLEBIKE newsletter (with the same consent and unsubscribe conditions as above).
- If chat is used: chat data.
- By using this site, brands and rental companies acknowledge and accept that, in the context of potential collaboration with JUNGLEBIKE, they may share information and data relating to their products, including but not limited to technical details, maintenance, and bicycle usage statistics. This data will be processed in accordance with our privacy policy and used exclusively to ensure effective maintenance management and after-sales follow-up.
6. How long does JUNGLEBIKE retain your Personal Data?
In accordance with the applicable regulations, your Personal Data will be retained for the time necessary to achieve the purposes pursued by JUNGLEBIKE:
- Requests for objection to processing are stored for a maximum of 5 (five) years from the date the right of objection is exercised.
- Requests for access and rectification of Personal Data are stored for a maximum of 5 (five) years from the last interaction with customer service or legal services.
- Sending information or offers (including newsletters) is stored for a maximum of 3 (three) years from your last interaction with JUNGLEBIKE.
- Provision and execution of Services are retained for a maximum of 10 (ten) full years from the last accounting or administrative year in which the Service was provided.
7. Is your Personal Data secure?
JUNGLEBIKE and its processors take the protection of your Personal Data very seriously. We implement all appropriate technical, physical, and organizational measures to ensure data security and confidentiality and prevent unauthorized access, alteration, or damage.
The Site may include links to external websites or sources. Users and Members acknowledge that this policy applies only to the Services and use of the Sites and does not cover information collected or processed on external sites or sources. Consequently, JUNGLEBIKE cannot be held responsible for the data collection and processing practices of such external sites, which are governed by their own privacy policies.
8. What are your rights regarding your Personal Data?
In accordance with data protection regulations, you benefit from the following specific rights: rectification (Article 16 GDPR), erasure (Article 17 GDPR), restriction of processing (Article 18 GDPR), data portability (Article 20 GDPR), objection to processing and profiling (Articles 21 and 22 GDPR), post-mortem directives (French Law No. 78-17 of January 6, 1978), and access (Article 15 GDPR).
Your right of access:
You may obtain confirmation from JUNGLEBIKE as to whether or not Personal Data concerning you is being processed and, where it is, access to that data and information relating to processing purposes, data categories, recipients, retention period, your rights, the right to lodge a complaint with the CNIL, data source, and the existence of automated decision-making, including profiling.
Your right to rectification:
You may obtain the rectification of inaccurate Personal Data concerning you and the completion of incomplete data.
Your rights to erasure and restriction:
You may obtain the erasure or restriction of use of Personal Data concerning you.
Subject to an express request and proof of identity, Users and Members may also retrieve their Personal Data subject to the right to portability, in a structured, commonly used, and machine-readable format, in order to transmit it to another data controller.
